Sheriff's department cleared of Jackson mistreatment claim

8/15/04 The Santa Barbara County Sheriff's Department did not mistreat Michael Jackson during his Nov. 20 arrest, the state attorney general's office has concluded.

A county source confirmed Friday that the attorney general recently alerted the department that the state had found no basis for comments Jackson made Dec. 28 in a televised interview on the CBS show "60 Minutes." Jackson claimed in the interview that he suffered a dislocated shoulder from the way he was handcuffed while in custody.

During a Dec. 31 press conference, Sheriff Jim Anderson said that if the investigation found Jackson's claims unfounded, he would request criminal charges against the singer for "false report of peace officer misconduct," a misdemeanor. Those charges have not yet been filed.

The county counsel's office has filed a motion requesting that Superior Court Judge Rodney Melville decide whether the release of information contained in the attorney general's finding would violate a gag order in the case. That request is scheduled to be heard Thursday.
