Jackson Chef Says Family Didn't Complain

SANTA MARIA, Calif. - A former Neverland chef's assistant testified Tuesday that the sister of Michael Jackson's accuser talked to him over about two weeks after the family left the pop star's estate and never complained of being treated badly or held against their will.

Angel Vivanco said he spent time with the sister after work about five or six times while the family was at the ranch in February and March 2003, the period in which prosecutors say Jackson molested the girl's brother and conspired to hold the family captive.

Vivanco said the sister continued to call him on the phone for about two weeks after they left but never said Jackson or anyone else had mistreated them.

Before Vivanco took the stand for a second day, Judge Rodney S. Melville reaffirmed his ruling Monday that barred the defense from asking Vivanco about several statements the sister allegedly made during their conversations, including a reference to her mother as "psycho mom."

Defense attorneys had hoped to use Vivanco's testimony to try to show that the accuser's family fabricated the allegations in an attempt to get money from Jackson.

They said in a motion last week that Vivanco would testify that the girl told him her mother and her mother's then-boyfriend were planning "something big" involving Jackson.

The "something big" statement was not among those barred but defense attorney Robert Sanger opted not to ask about it before ending his questioning of Vivanco.

On Monday, Vivanco testified that the accuser's younger brother once demanded that he make him a milkshake with liquor and had also held a kitchen knife to his throat. Vivanco also said the accuser once used a curse word while demanding food.

Under cross-examination by prosecutor Ron Zonen, Vivanco acknowledged he did not report those incidents when he was first interviewed by law enforcement authorities.

Vivanco said that when he was asked about the family he did not recognize their last name. He said, however, that he reported the incidents to two supervisors.

Prosecutors said in a motion last week that Vivanco, an adult, had a "quasi-sexual" relationship with the then-16-year-old sister, making her "a victim of felonious sexual misconduct by a defense witness employed by the defendant." The issue was not raised in testimony.

Vivanco was one of several witnesses called to the stand Monday in a defense challenge to prosecution claims that Jackson exposed the children to alcohol and adult materials as a precursor to molestation. The defense suggested instead that the boys found the items on their own.

Vivanco was also among witnesses portraying the boys as wild and rude.

In the milkshake incident, he said, the accuser's brother threatened to report him to Jackson if he didn't put the liquor in.

"He told me if I didn't do it he would tell Michael and I would get fired," Vivanco said.

Of the knife incident, he said it ended when someone else scolded the brother.

And he quoted the accuser as once demanding, "Give me the (expletive) Cheetos."

In other testimony Monday, Neverland security guard Shane Meredith testified that he caught Jackson's accuser and his brother with a half-empty bottle of wine, and maid Maria Gomez told the jury that she once saw adult magazines in the brother's backpack.

The defense attacked the family's claims of being held against their will, calling witnesses who said there was no hint of captivity when the mother went to a spa for a body waxing or when her children went to an orthodontist to have their braces removed.

Jackson, 46, is accused of molesting a 13-year-old former cancer patient in February or March 2003 and plying him with wine. He is also accused of conspiring to hold the boy's family captive to get them to rebut a TV documentary in which the boy appeared with Jackson, who said let children sleep in his bed but it was non-sexual.

Outside court Monday, Jackson spokeswoman Raymone K. Bain said the defense expects to call CNN's Larry King to testify Thursday. The defense is expected to asked whether attorney Larry Feldman once said the accuser's mother made up the molestation story.

Feldman, who has denied that story, was contacted by the family after they left Neverland and he referred them to a psychologist who reported molestation suspicions to authorities.

Jackson's alleged victim denied abuse in interview with social worker

SANTA MARIA, United States (AFP)

Michael Jackson's child sex accuser told social workers two years ago that the star had never touched him inappropriately, the pop icon's trial heard.

Social worker Irene Peters, of the sensitive case unit of the Los Angeles child welfare department, said she interviewed the 13-year-old future accuser on February 20, 2003, the same general period during which Jackson is accused of abusing him and holding him and his family captive.

"Everybody thinks Michael Jackson abused me," she quoted the child as telling her. "He has never touched me," he added during the interview at the home of his mother's then boyfriend.

The boy also said he had never slept in the same bed as Jackson, 46, although the star himself said in an explosive television documentary that sparked the molestation investigation against him that the two had shared a bed.

"I asked him very point blankly: 'Did you ever sleep in a bed with Michael Jackson?'. He told me, 'no'," Peters told trial jurors in the California town of Santa Maria.

Peters said the boy's mother, accused by the defense of inventing the allegations against Jackson in order to extort him, also praised the star and said that nothing untoward had ever happened between the singer and her son.

The woman also showed the social workers a video of Jackson and her son walking around and looking at swans. "She said she wanted to show us how caring and loving Michael was," Peters told jurors.

"She said Michael had been like a father to her children," Peters said.

Peters said that two Jackson aides were present when the social workers arrived at the apartment, but they were asked to leave the room before the interviews began.

Jackson has denied 10 charges, including child abuse, plying the boy with alcohol to seduce him and holding him and his family prisoner for three weeks in late February and March 2003.

But Peters said the woman never complained to her of being held against her will by Jackson and his aides.

The alleged victim's mother claimed during her testimony that she was menaced into lying about the Jackson's conduct with her child to the social workers by the two Jackson's aides who were present at the home and recorded the interview.

The woman told social workers she was "totally appalled by the negative attention her children were getting" following the February 6, 2003 broadcast of the documentary in which her son was seen holding hands with Jackson, who admitted to sleeping in the same bed as children, Peters said.

she said that in training she did know that boys are different then girls and that there was no accusation from this family of abuse

court tv just reported that sneddon asked dscf worker if it is standard pratcie to bring in a police officer with her when doing sexual molestation claim, she said she did bring in a la officer , the first time trying to meet up with family, she then said the la figured the story out and said its not there jurisdiction if it happened at neverland

OMG, this is BIG! Remember Kiki Fournier saying the same stuff, about the knife??? She tried, however, to cover this up by saying that maybe it was a joke, but she admitted she was really scared... Now, for the second time we hear the same story!

God, this kids, they've got serious issues!!!

Boy, Now, would really make sense for Michael to abused this boy during the time when this family were intervew by DCSF workers and when the whole world was on his ass with that documentary? I don't think so Sneddon? It don't make sense. Plus, Michael never ever said he slept in the same in bed with these two hoodlums. That's was of course taking out of context.

Sneddon is a dumdass for trying to bring up that thing that the social owrker isn't trained well and she didn't know what the hell she was doing while interviewing this family.

I personally don't think it matters how she handled the family. What the family said is what matters the most.

I highly doubt that the jury is questioning this social worker's expertise because they could only be focused on what the family did/said.

And another thing....What is the exact time period in which Gavin was allegedly molested??

Even if the jurors not paying attention was incorrect, if they weren't taking notes, etc., maybe because they really have already made up their minds and don't need to be convinced any longer by the defence that Michael is innocent. They had to listen more closely to the prosecution because they have the burden of proof - I think the jurors were convinced of Mike's innocence awhile ago already and this is just gravy.
