he shuouldnt be called victim at all, closing statments should include alleged victim, or possible, or potential, i mean there are plenty of adjectives suitable.

So what the hell is so "adult" about it then? :idontknow Is it just me or are they just looking for anything to claim as evidence if there isnt any physical evidence.

Eventually, something which Melville has ruled that has subsequently acted in the favour of the defense. The prosecuting side isn't going to be happy about the ruling against the introduction of the material from the 1993 raid, as most of their case is based on the foundations from the past investigation.

The outcome of today's Hearing seems very GOOD & SUPPORTIVE for defence team!! YES!!
Things are turning better, even if the jurors are show the magzines, it is not admissible or fact.
Everyone has access to buy such magazines from any local shop! It is a common to public!!
Nothing can be implied from those magazines against MJ, No!!, it will be ignored by the Jury.
1)NEVER MIND WHAT THE JUDGE RULED ABOUT MICHAEL'S OWN FOOTAGE ON BASHIR,
THE JUDGE WILL LATER DURING THE TRIAL DIRECT THAT MICHAEL BE ALLOWED, CAUSE
THE DEFENCE MUST BE GIVEN THE OPPORTUNITY TO DEFEND ANY NEW EVIDENCE IN A CASE, DENIAL WILL BE A QUESTION OF LAW FOR ANY COURT OF APPEAL PROCEEDING AGAINST THE JUDGE'S DECISION TO DENY DEFENCE TEAM OF THEIR RIGHT TO DEFENCE!!
2) THE ACCUSER WIL TESTIFY IN AN OPEN COURT!! THAT IS THE BEST THING TOO, HE CANNOT BE HIDDEN AWAY FOR TELLING THOSE 'BIG LIES' AND HE WILL FACE THE PUBLIC!
3) YES , THEY ARE NOT 'VICTIMS', THE CASE HAS TO BE HEARD, WHEN ALL IS CONCLUDED, THE JUDGE THEN CAN DECIDE ON HIS CLOSING STATEMENTS DIRECTING THE JURORS.

NOT BAD TODAY INDEED, SURE THE JUDGE WILL ALLOW MJ'S FOOTAGE DURING TRIAL!!

Judge rules that child accuser must face Michael Jackson in court

SANTA MARIA, California, Jan 28 (AFP) - The teenage boy who accused pop icon Michael Jackson of child abuse must face the superstar in open court, a judge ruled Friday.

Judge Rodney Melville made the critical decision over prosecutors' objections in the last pre-trial hearing ahead of Monday's official start of the trial of one of the most famous people ever to face justice on such serious criminal charges.

But while ruling that the 15-year-old alleged victim and his 14-year-old brother must testify in open court instead of from behind closed doors, Melville warned he would not tolerate any intimidation of the children.

"Whether I keep an open courtroom will depend on what happens during their testimony," Melville said, warning he would tolerate no "hand gestures, mutterings" or any other expressions towards the children from the gallery.

"It is critical there be no disruption in their testimony," he told the rival lawyers in the case after Jackson's lawyers won their bid to force the boys to testify in open court.

The boy alleged to authorities that Jackson had sexually molested him on several occasions in early 2003 at Neverland Ranch, near the California town of Santa Maria where the legal proceedings are taking place.

Prosecutors claim in their charges against the pop star that the boy's younger brother witnessed two of the alleged incidents and will call both boys to testify about the alleged incidents.

Prosecutors had moved to shield the boys from the glare of publicity when they take the witness stand, but Jackson's attorneys said it was unfair for the accusers to give evidence via an audio feed from a closed room while Jackson, 46, had to face the world's scrutiny.

Prosecutor Gordon Auchincloss told Melville that the boys would be stigmatised and shamed by their testimony if it was given in front of the press and public.

He said the brothers and their family already changed their schools, their names and had been forced to "hide out" since their intimate allegations first made world headlines in November 2003.

"The shame involved in a child consenting to these acts is unbelievable, Auchincloss said, claiming Jackson had bought the boys' silence through gifts and other alleged wiles.

"To anyone who thinks we should put these young boys in the path of this train, I ask how would you feel if it was your child?" he said.

But Jackson's chief lawyer Thomas Mesereau disputed the portrayal of the boys as being vulnerable victims in need of the court's protection, suggesting that the motive for the claims against Jackson was financial.

"They are in their mid-teens and are not tiny little children. They are not the little lambs the prosecutor says they are," Mesereau said rebuffing Auchincloss's argument.

He stressed that every aspect of Jackson's life had come under scrutiny since his November 2003 arrest, so it was fair that those who first made the claims against the singer should be made to do so in public.

"At least let Michael Jackson, who is on trial in a public proceeding, confront his accusers in a public proceeding," Mesereau told the judge.

Summary:

Anyway, this was far from a "blow" to the defense as some of these cry baby - sky is falling reports. The defense made a pretty good showing today.

*Judge ruled against Pros. about showing the ABC version of the Bashir "documentary" but will allow the Euro version.

*The judge will consider (although he should go ahead and rule) allowing Mike's Bashir footage captured by Mike's camera in.

*The prosecution can't hide these grown-looking teenaged kids from the public. They will be forced to testify in open court.

*Pros. can't call them "victims" until closing arguments.

*Pros. can't use stuff taken from the ranch in 1993 or stuff that doesn't belong to Mike.

*Pros. can't call the material "pornography", "obscene" or "erotic".

*The defense can refer to them as "the government" and not "the people"

*Judge rejected a motion from Pros. basically whining that the defense was calling them names.

*Judge is forcing Bashir to testify. Rules against him hiding behind the Cali. Shield Law.

Auchincloss need to shut the f**K up! Like Mez said, these ain't little under the age of 12 boys. This is a street wise 15 year old liar. He ain't no child, he's a teen. Whatever Aunchincloss!

if hes letting LWMJ in, it will be such a miscarraige of justice to not let Mikes footage in. Its essentially the same thing in a different light. Its like giving them half the story.
