Michael Jackson's Doctor to Be Charged With Manslaughter

Wednesday, August 19, 2009
By Jana Winter

Michael Jackson’s personal physician will be charged with manslaughter within the next two weeks, a law enforcement source told FOXNews.com.

The source initially said Dr. Conrad Murray could be arrested as soon as next Wednesday – but investigators have decided to execute one more search warrant, likely at a Los Angeles pharmacy, next week in an attempt to gather more evidence against him. The arrest is now expected the following week.

Murray isn’t the only doctor who faces criminal charges in connection with Jackson's death on June 25. A law enforcement source told FOXNews.com that Jackson’s longtime dermatologist, Dr. Arnold Klein, will be hit with charges related to medical malpractice. Investigators are still building their case against Klein, and he will not be arrested for at least another two weeks, the source said.

Jane Robison, spokeswoman for the Los Angeles County District Attorney's office, denied that prosecutors had decided to charge Jackson's physicians. “Until police complete their investigation and bring it to our office, there is no way to know what charges may be filed and against whom,” she said.

But the source told FOXNews.com that the DA's office is currently in talks with investigators about whether they will offer Murray the option of surrendering in Los Angeles, or if he will be arrested in Houston, where he is currently staying.

Investigators initially had hoped to charge Murray with a more serious crime than manslaughter – a defendant may be charged with second degree murder in California without the presence of a motive – but prosecutors are concerned that a jury will be unlikely to convict without one, sources said. Unless a "smoking gun" is found in next week’s search, Murray will be charged with manslaughter.

Law enforcement sources previously told FOXNews.com that Murray admitted he gave the King of Pop the intravenous anesthetic propofol to help him sleep just hours before his death – and that propofol was at least a contributing factor in the 50-year-old entertainer's death.

Murray posted a video on YouTube Tuesday that his legal team said was intended to be seen by his friends and patients. The video, which was Murray’s idea, was shot last Wednesday at a Houston residence, a spokeswoman for his attorneys said.

Sirius Video, a Houston production company, was hired to film the cardiologist's first public words since Jackson’s death. But a company spokeswoman would not say who bankrolled the video. Murray is reportedly broke; his latest money troubles involve possible eviction from his Las Vegas home.

In the one- minute video, a bedraggled and teary-eyed Murray thanked his friends and supporters and said he has been unable to check his e-mail or return phone calls due to death threats.

“I want to thank all of my patients and friends who have sent such kind e-mails, letters and messages to let me know of your support and prayers for me and my family," Murray said.

"Because of all that is going on I’m afraid to return phone calls or use my e-mail. Therefore I recorded this video to let all of you know that I have been receiving your messages. I have not been able to thank you personally, which you know is not normal for me.

“Your messages give me strength and courage and keep me going. They mean the world to me.

“Please don’t worry. As long as I keep God in my heart and you in my life, I will be fine. I have done all I could do. I told the truth and I have faith the truth will prevail.”

A spokeswoman for Murray’s legal team said the video was simply Murray’s way of thanking his supporters, and that the doctor’s friends and supporters who had provided contact information to the attorneys received an e-mail with the link to the YouTube video yesterday.

But others said the video was Murray’s "last testament" – a transparent attempt to garner sympathy and influence a jury pool.

“This was a total PR stunt,” said former Broward County prosecutor Kenneth Padowitz.

“I think what they’re trying to do is humanize him, trying to make him seem like this is somebody that maybe you could know and this is not a bad guy–that’s what they’re trying to do,” Padowitz said. “And for that limited purpose, it probably was effective….

“Is it a transparent attempt to get feelings in his favor? Yeah. It’s a gimmick.”

Padowitz said the video was certainly intended for widespread viewing, despite what Murray’s legal team says. And having his only statement come in a video format allowed for total control over what he said.

“They did it this way so there could be no questioning by a reporter, no cross examination by anyone, or anyone asking a question he could not answer," Padowitz said. "They just basically put out a PR piece.”

Klein, a Beverly Hills dermatologist, has admitted giving the painkiller Demerol – but not propofol – to Jackson, who suffered from insomnia. Klein has said he found out that Jackson was taking Diprivan, the brand name of propofol, to sleep when he was touring in Germany and warned his longtime friend of the dangers surrounding the intravenous anesthetic.

Last month the Los Angeles coroner issued Klein a subpoena to turn over all of Jackson’s medical records.

Klein also inserted himself into court proceedings related to custody issues involving Jackson’s three children.

In a statement linked to on Klein's Twitter account earlier this month, his attorney wrote: “Dr. Klein has always had a special relationship with Paris Katherine and Prince Michael, loves and cares deeply for these children and is looking out for their best interest. Dr. Klein has been involved with the children in sharing holidays and other special events and wishes to have the ability to continue his involvement as a very close friend of their father and offers his guidance and protection forever.”

I don't understand why you'd announce something like this though. I'd rather have Murray and Klein and whomever else totally caught off guard. Also consider this is Fox News aka, Faux News reporting this. They still get my wary eye.

I'm wondering if Murray will attempt to name names and spill beans about the WHYS and HOWS about what went down in order to get the charge reduced. I've said it before, Murray may very well be the fall guy in all of this and that this started somewhere else. I mean, look at Dr. Klien.

Can he really have his charges reduced though? I mean obviously the police have enough evidence to place the syringe in Murray's hand and that has to count for something. Even if it's revealed that other people are involved, unless Murray can say that someone practically held a gun to his head and forced him to use the drugs, still the blame should be on him. Either way, the ball has started rolling.

DA: Report Dr. Murray Charged With Manslaughter ‘Totally False’

LOS ANGELES, Calif. --
A report that Dr. Conrad Murray, Michael Jackson’s doctor at the time of his death, will be charged with manslaughter in the next two weeks is “complete and totally false,” the LA District Attorney’s Office told Access Hollywood.
FOXNews.com reported on Wednesday that the doctor, who has been interviewed several times by authorities, would face criminal charges due to his alleged involvement in the King of Pop’s death.
However, the DA’s office told Access that was not the case.
On Tuesday, Dr. Murray took to YouTube to break his silence, thanking patients and friends for their support.
“I want to thank all of my patients and friends who sent such kind e-mails, letters and messages, to let me know of your support and prayers for me and my family,” Murray said in the one-minute clip. “I have done all I could do. I told the truth and I have faith the truth will prevail.”
Earlier this week, an attorney for Katherine Jackson, Michael’s mother, told the Associated Press that she is considering a wrongful death lawsuit with Murray’s being the main name brought up.

*sigh*

Well, either way this is not finished yet. A man died. Not just any man. Michael Jackson. That name is worldwide. This will never rest until someone goes to jail, or will have to face some form of penalty.

Michael deserves to have even his death solved. God I still cannot believe this man is gone. He was so strong and went through so much...he was beautiful. I am so sad that he's no longer walking this earth....one of the few good men in this world..

Fox News reporting their lies again. No way would there be time table for charges. Hell, we could see charges tomorrow. We won't know until they're filed. Because that will be on every news station when they are filed and who the arrest warrants are for. I hope it's soon.

For international readers, please keep in mind this is coming from Fox News. For News is notoriously known for its terrible reporting, which isn't to say it is any worse than CNN and MSNBC. For me, they're equally bad.

I didn't even read the article. Read the headline, noticed the source, and skipped the text. No wonder I don't watch anything from CNN, Fox News, and MSNBC. Democracy Now (http://www.democracynow.org) works for me, but it usually does not report on celebrity news.

I know this isn't really important but there is a TV where I work at on all the time and the station they always put on is FOX News, and a customer came in there and told a cashier that Fox is disturbing and that we should change it to something else.

We tried telling that to one of our managers but of course....who the hell are we to tell them what to do?

Saphster, we're gonna bring YOU up on charges for that GORGEOUS PIC in your siggy! But I digress...
Murray said he gave Michael Propofol.
Its against the law.
Most likely not intentional, but against the law.
It was wrong.
When you break the law, you go to jail.
Sorry...:glare:

*sigh* So much for some good news... :( Even though this is a bummer, I still hope charges will be pressed against him. He adminitered the drug away from a hospital. It's illegal. To be honest, I'm starting to lose hope that anyone will pay for this mess. :( Surely someone should've been arrested by now. It's been two long, agonising months!

There should be some charges for sure.. he admitted he gave the Propofol to Mike whether he knew or not about Michael's good health or not, whether he knew or not about what Michael was taking (other meds) or not, HE GAVE THAT DAMN PROPOFOL AND IT TOOK THE LIFE OF OUR MICHAEL! HE GAVE IT OUTSIDE HOSPITAL SETTING!! :pullhair:pullhair
I don't care if it's a revoke of license, prison for several years---- THERE SHOULD BE CHARGES!! :pullhair:pullhair:pullhair:pullhair

The only "good" thing that can come from this is that there's no statute of limitation when it comes to murder/manslaughter charges(meaning there's no time limit). We can only hope that police are going through everything and everyone with a fine toothed comb. When they get enough evidence, someone or a group of someones will be brought to justice. With all that we've learned recently about what Michael has been through, someone paying for the fact that Michael is no longer here...Michael deserves that much.

Good! I hope they lock his a.ss up! How do you leave someone alone when they're heavily sedated with a medication that isn't even supposed to be used outside of a hospital? Are you crazy?

I know. It sounds totally unprofessional for a so called 'doctor' to do. You don't leave to go make phone calls, or anything! For all that money Michael was paying him that doctor should have been kissing Michael's ass and tucking him in bed like a baby. I don't like this guy. I can see through him...

One day someone will pay. Just wait.
