Sources: Mother May Plead Fifth, Jeopardize Conspiracy Case

April 12, 2005 – The mother of the boy who has accused Michael Jackson of molestation in his current criminal trial may not testify at all, ABC News has learned, putting the prosecution's conspiracy case against the singer in jeopardy.

Jackson, 46, is on trial for allegedly molesting a now-15-year-old boy who spent time at his Neverland ranch and appeared with him in the 2003 British documentary "Living With Michael Jackson." The singer has pleaded not guilty to 10 charges that include felony conspiracy with 28 overt acts involving child abduction, false imprisonment and extortion. The conspiracy charge against Jackson refers to his alleged attempts through associates to quiet the alleged victim and his family and send them away to Brazil after "Living With Michael Jackson" aired.

Sources told ABC News that the alleged victim's mother, who was scheduled to take the stand today, sees potential legal problems if she testifies. In a motion filed under seal, the prosecution has asked that Jackson's defense be prevented from asking the mother any questions about welfare fraud, sources close to both sides told ABC News. However, in opening statements, Santa Barbara County, Calif., prosecutor Tom Sneddon told jurors that the mother "obtained welfare funds when she wasn't entitled to them. She's going to tell you that, and she's going to admit that."

Sources told ABC News that the mother has now changed her mind and does not want to admit anything. She has threatened to plead the Fifth Amendment and refuse to answer any questions, which would put the rest of her testimony in jeopardy. The mother never saw any sexual molestation of her son and would not be able to testify about that aspect of the prosecution's case. However, she is a key witness for the conspiracy case against Jackson.

The prosecution alleges that five unindicted Jackson associates played various roles in surveilling the alleged victim's family, taking the boy and his siblings out of school, making them virtual prisoners of "The King of Pop" after "Living With Michael Jackson" aired, getting passports for the family and pressuring them to leave the country.

ABC News has reported that Jackson's defense team says the conspiracy allegations are false and that it has receipts and paperwork that prove the alleged victim and his family were never held virtually hostage by the star. The defense argues, ABC News has reported, that the family requested Jackson's help because they complained about being harassed after the broadcast of the British documentary and that they willingly came to Neverland.


Damn I hope this isn't true.
I want that bitch to get on that stand for her allegedly molested son.
Any other parent whose child was molested and held captive would get on the stand and testify.
Her not doing so only proves to me that she doesn't want justice for her son.

The testimony has shifted to the family members of the accuser in the current case and is focusing on the conspiracy charges:

- on the stand is the stepfather of Gavin.
- he is testifying about receiving phone calls from Janet when the family was back at Neverland. Said that she sounded upset and distressed and that she felt that she was being followed.
- he is testifying about a series of phone calls that he received from Jackson's associate who was calling the house continuously every 15-30 minutes. He was trying to get the mother to sign the contract that the family participate in the rebuttal video.

Cross-examination will begin after the break...


hmmmm......Interesting but I think we need to hear the whole testimony before we just jump to conclusions.
Meserau better grill this MF's ass.

If Janet Arvizo doesn't testify I will be royally pissed off.

You can't have all these main accusers that aren't willing to testify to put this abuser behind bars. They are fu*cking hiding.

Many phone calls and he doesn't do anything!
And why would Michael's people be calling him if the mother was in Neverland?

I agree with you Vicky. These accuser's that are supposed to have a son/brother/stepson to have been abused inappropitely by Michael Jackson shouldn't be hindin'. If they want to put him behind bars, they should speak up and say "oh I saw him do it.." or "he touched him like this..." and have physical evidence to show that Michael did it. Not be unsure if they should testify or not! I mean, if I was abused sexually by Michael and I had the chance to testify, I would say "bring it on" and that will be it. My part here is done.

I mean come on Janet, if June Chandler had the courage to face Tom, then you should to. I mean you're the one that is actually behind all this! Face the damn man, for goodness sake. Stick your chin up and put up a fight! Show the defense you aren't afraid, pour your heart our to them, tell them what the did to your son!

I am just really amazed on how cowardly Janet is acting. I mean, Gavin, Star, June, the former maids/cook, Devilian stood up to them (the defense) so why should the mum not do the same. I know Janet did it last September, but not know! This could ruin Michael's and her careers (if she has one).

Janet, if you want to put Michael Jackson behind bars for life, them flipping show you are eager to do such a thing. Even I would do it! Don't care if it the allegation is true or not, stand up the defense, not hide behind your husband. Heck! Even Jay, is going on the stand.

i cant believe that she might not testify! If that was my son, id want to get out there and tell everyone what Michael ''has put the family through''! what a silly cow! she is so obviously just scared of being cross examined!

If Janet isn't going to testify it will just be more obvious for the jury that nothing happened.. If that was my son and he'd been molested I'd be up on the stand in a heartbeat.. First she got guts to accuse Michael but when it's time to testify she backs of.. what a jerk!

Hell. The defense should call her anyway. So she can get up there and plead the 5th in front of the jury. It won't look good.

The news reporting is become rediculous. They only harp on one detail and leave everything else in the dark.
